Definitions
- Publishing House Elevation by nature:
- Client: the natural or legal person whether or not acting in the course of a profession or business who enters into an agreement with Publishing House Elevation by nature and/or has registered on the website.
- The Agreement: the agreement between Publishing House Elevation by nature and The Client.
- Services: the development, preparation, care and delivery of breakfast products.
- Account: The aggregated data of the Client used as identification to use Publishing House Elevation by nature service. The Account can only be accessed with the user ID linked to this Account and password.

Applicability
- These general terms and conditions apply to any existing and future agreement, unless the parties agree otherwise in writing prior to the conclusion of the agreement.
- If the Client, in his order, confirmation or communication containing acceptance, includes stipulations or conditions that deviate from, or do not appear in the General Terms and Conditions, these are only binding for Publishing House Elevation by nature if and insofar as they have been expressly accepted in writing by Publishing House Elevation by nature.
- Before the remote agreement is concluded, the text of these General Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, before the remote agreement is concluded, the entrepreneur will indicate in what way the general terms and conditions can be inspected at the entrepreneur and that at the request of the consumer they will be sent free of charge as soon as possible.

Prices and information
- All prices stated on the Website and in other Publishing House Elevation by nature Products and Services are inclusive of VAT and, unless otherwise stated on the Website, other levies imposed by the government.
- The Website and its content are displayed as accurately as possible. However, Publishing House Elevation by nature cannot guarantee that all prices and other information are at all times correct and complete. All prices and other information on the Website and in other materials originating from Publishing House Elevation by nature  are subject to obvious programming and typing errors.
-Publishing House Elevation by nature cannot be held responsible for (color) deviations due to screen quality.

Conclusion of agreement
- The agreement comes into effect when the client accepts the offer of Publishing House Elevation by nature and fulfills the conditions.
- If the Client has accepted the offer electronically, Publishing House Elevation by nature will confirm the receipt of the acceptance of the offer electronically directly on the screen. As long as the receipt of this acceptance has not been confirmed, the Client has the possibility to dissolve the Agreement.

Execution of agreement
- As soon as the order has been received by Publishing House Elevation by nature, Publishing House Elevation by nature will send the products, taking into account the legal delivery time, as soon as possible.
- Publishing House Elevation by nature is entitled to engage third parties for the execution of the obligations resulting from the Agreement.
- The Website shall clearly describe, timely prior to the conclusion of the Agreement, the manner in which delivery will take place and the period within which the products will be delivered. If no delivery period has been agreed or stated, products will in any case be delivered within 30 days.
- Should Publishing House Elevation by nature not be able to deliver the products within the agreed term, it shall inform Client thereof. Client can in that case agree to a new delivery date or he will be given the opportunity to dissolve the Agreement free of charge.
- Publishing House Elevation by nature advises the Client to inspect the delivered products and to report the detected defects within a reasonable time, preferably in writing or by e-mail. See article on warranty and conformity.
- As soon as the products to be delivered have been delivered to the specified delivery address, the risk, where it concerns these products, is transferred to Customer. If expressly agreed otherwise, the risk is transferred to the Customer at an earlier stage. If Client decides to pick up the products, the risk is transferred upon transfer of the products.
- Publishing House Elevation by nature is entitled in consultation with the Client to deliver a similar product of similar quality as the ordered product, if the ordered product isn't available.

- Once the products to be delivered have been delivered to the specified delivery address, the risk, where these products are concerned, passes to Customer. If expressly agreed otherwise, the risk shall pass to Customer at an earlier stage. If Client decides to pick up the products, the risk is transferred upon transfer of the products.
- Publishing House Elevation by nature is entitled in consultation with the Client to deliver a similar product of similar quality as the ordered product, if the ordered product is no longer available. Client is in this also entitled to dissolve the agreement free of charge.

Registration
- The Client can register on the Website of Publishing House Elevation by nature in order to make full use of facilities offered by the Website.
- During the registration procedure the Client creates a username and password with which he can log on to the Website after registration. Customer is responsible for choosing a sufficiently reliable password.
- Client must keep his login details strictly confidential. Publishing House Elevation by nature cannot be held liable for abuse of the login details and may always assume that a Client registering on the Website is indeed that Client. Everything that happens through the Client's account falls under the responsibility and risk of the Client.
- If Client knows or suspects that his login details have come into the hands of unauthorized persons, he shall change his password as soon as possible and/or notify Publishing House Elevation by nature thereof, so that Publishing House Elevation by nature can take appropriate measures.

Personal data
- Publishing House Elevation by nature may process personal data concerning The Client, which The Client has made available to Elevation by nature, for the purpose of providing the Service or in the context of complying with a legal obligation.
- The Client agrees that Publishing House Elevation by nature stores, processes and uses all data provided by The Client and generated by use.
- Processing of personal data by Publishing House Elevation by nature takes place in accordance with the applicable laws and regulations in the field of the Personal Data Protection Act.

Payment
- Payment is made in advance by Ideal or Creditcard.

-Publishing House Elevation by nature is free in its choice of offering payment methods and these may also change from time to time.
- In case of payment after delivery the Client has a payment term of 14 days starting the day after delivery.
- The stated prices of the Products are in Dollars and include VAT, unless otherwise stated.
- If an order is returned because the Customer is not at home, this will be at the expense of the Customer. The purchase amount of the Products will not be refunded to the Customer. However, the Client is entitled to a credit note worth 15% of the purchase amount.
- In case Publishing House Elevation by nature, as a result of non-payment by the Client, is forced to take collection measures, all costs resulting from this shall be for the account of the Client with a minimum of 15% of the amount due to Publishing House Elevation by nature.
- Payment by the client shall first serve to reduce the collection costs due, thereafter, to reduce the interest due and thereafter to reduce the principal amount due.
Payment is due at the time of conclusion of the agreement, unless otherwise agreed.
- After payment, the Services will be delivered on the date and time set.

Guarantee and conformity
- This article is only applicable if the Customer is not acting in the exercise of his profession or business. If a separate guarantee is given on the products by Publishing House Elevation by nature, without prejudice to what has just been stated, this applies to all types of Customers.
- The Publishing House Elevation by nature guarantees that the products comply with the Agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability and the existing legal provisions and/or government regulations on the date of conclusion of the agreement.
- A guarantee provided by Publishing House Elevation by nature manufacturer or importer does not affect the legal rights and claims the Client already has and can invoke under the Agreement.
- If the delivered product does not comply with the Agreement, the Client shall notify Publishing House Elevation by nature within a reasonable period after he has found the defect.
- If Publishing House Elevation by nature considers the complaint justified, the relevant products will be repaired, replaced or reimbursed after consultation with Client. The maximum compensation shall, with due observance of the Article on liability be equal to the price paid by Client for the product including VAT.

Complaints procedure
- If the client has a complaint about a product (in accordance with Article on guarantee and conformity) and/or about other aspects of the service of Publishing House Elevation by nature, he can file a complaint with Publishing House Elevation by nature by telephone, e-mail or by mail. See contact details at the bottom of the Terms and Conditions.
- Publishing House Elevation by nature will respond to the Customer's complaint as soon as possible, but in any case, within 3 working days after receipt of the complaint.
- If it is not yet possible to give a substantive or definitive response, Publishing House Elevation by nature will confirm within 3 working days after receipt of the complaint and give an indication of the period within which it expects to give a substantive or definitive response to the Customer's complaint.

Liability
- This Article only applies if Customer is a natural person or legal entity acting in the exercise of his profession or business.
- The total liability of Publishing House Elevation by nature towards Client for attributable shortcomings in the fulfillment of the Agreement shall be limited to compensation of no more than the amount of the price stipulated for that Agreement (including VAT).
- Liability of Publishing House Elevation by nature towards the Client for indirect damage, including in any case -but explicitly not exclusively- consequential damage, loss of profit, missed savings, loss of data and damage due to business stagnation is excluded.
- Apart from the cases mentioned in the previous two paragraphs of this article, Publishing House Elevation by nature is not liable for any damages towards the Client, regardless of the ground on which an action for damages would be based. However, the limitations mentioned in this article shall cease to apply if and insofar as damage is the result of intent or gross negligence of Publishing House Elevation by nature.
- The liability of Publishing House Elevation by nature towards the Client for attributable shortcomings in the fulfillment of an agreement shall only arise if the Client gives Publishing House Elevation by nature immediately and properly notice of default in writing, setting a reasonable time limit for remedy of the shortcoming, and Publishing House Elevation by nature remains in breach of its obligations even after such time limit. The notice of default should contain as detailed a description as possible of the shortcoming, so that Publishing House Elevation by nature is able to respond adequately.
- Condition for the arising of any right to compensation is always that the Client reports the damage in writing to Publishing House Elevation by nature as soon as possible, but at the latest within 30 days, after it has arisen.
- In case of force majeure Publishing House Elevation by nature is not obliged to compensate any damage caused to the Client as a result.
